Terms and Conditions
Effective Date: April 1st, 2026
These Terms and Conditions (“Terms”) govern your access to and use of the website https://hairtreatments.ca/ (the “Site”) and any purchases made through the Site (the “Services”), operated by Professional Hair Treatments Canada (“we,” “us,” “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least the age of majority in your province or territory of residence to place an order. By placing an order, you confirm that the information you provide is true, accurate, current, and complete, and that you are authorized to use the payment method submitted.
2. Account Registration
You may browse the Site without an account, but certain features (order history, professional pricing, wishlists) require registration. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
3. Products and Availability
We make reasonable efforts to display product descriptions, ingredients, photos, sizes, and availability accurately. Colours, packaging, and minor formulation details may vary as manufacturers update their products. Stock levels are not guaranteed; an item shown as available may sell out before your order is processed. If we cannot fulfil an item after payment, we will notify you and refund the affected portion of your order.
All products sold are intended for use in accordance with the manufacturer’s instructions. Several products in our catalogue, including smoothing, keratin, nanoplastia, and hair-botox treatments, are designed for professional salon use and should be applied only by trained stylists in a properly ventilated environment.
4. Pricing, Taxes, and Currency
All prices on the Site are listed in Canadian Dollars (CAD) and exclude applicable taxes unless otherwise stated. Federal and provincial sales taxes (GST, HST, PST, or QST) are calculated at checkout based on your delivery province.
We reserve the right to correct pricing errors and to change prices at any time before you complete checkout. If we discover a pricing error after you have placed an order, we will contact you to confirm whether you wish to proceed at the corrected price or cancel for a full refund.
5. Orders and Acceptance
Submitting an order is an offer to purchase. Your order is accepted only when we send a dispatch confirmation email; the prior order-confirmation email is an acknowledgement of receipt, not an acceptance. We may decline or cancel any order at our discretion, including where we suspect fraud, where stock is unavailable, where a price was listed in error, or where shipping restrictions apply.
6. Payment
We accept the payment methods displayed at checkout. Payments are processed by third-party payment providers (such as our card processor and any wallet services). We do not store full credit-card numbers on our servers. By submitting payment information, you authorize the relevant processor to charge the total amount of your order, including taxes and shipping.
7. Shipping
Shipping terms, processing times, delivery estimates, and carrier information are described in our Shipping Policy at https://hairtreatments.ca/shipping-policy/, which forms part of these Terms.
8. Returns and Refunds
Returns, refunds, and handling of defective or damaged items are governed by our Refund and Returns Policy at https://hairtreatments.ca/refund_returns/, which forms part of these Terms.
9. Professional and Wholesale Accounts
Salons, stylists, and beauty professionals may apply for a professional account to access wholesale pricing and bulk ordering. Approval is at our discretion and may require verification of professional credentials. Professional pricing, minimums, and payment terms are governed by the separate professional-account agreement provided upon approval.
10. Promotions, Coupons, and Loyalty
Promotional codes, discounts, free-shipping thresholds, and loyalty rewards are subject to specific eligibility rules and expiry dates communicated at the time of the offer. They cannot be combined unless expressly stated, have no cash value, and may be modified or withdrawn at any time.
11. User Conduct
When using the Site you agree not to:
- Misrepresent your identity, payment method, or shipping address.
- Resell products in a manner that violates manufacturer guidelines or applicable law.
- Submit false reviews, manipulate ratings, or interfere with other users’ accounts.
- Attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to the Site.
- Upload content that is unlawful, infringing, defamatory, or harmful.
We may suspend or terminate accounts that breach these rules.
12. Intellectual Property
All content on the Site, including text, images, graphics, logos, product photography, and the underlying code, is owned by [Legal Entity Name] or its licensors and is protected by Canadian and international intellectual-property laws. Brand names and product names of third-party manufacturers (including but not limited to Felps Professional, Prohall, and MQ Professional) belong to their respective owners and are used only to describe the goods we resell.
You may view, download, and print pages from the Site for personal, non-commercial use. Any other use, including reproduction, redistribution, or commercial use, requires our prior written consent.
13. Reviews and User-Submitted Content
By submitting a review, photo, comment, or other content to the Site, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, and display that content in connection with the Site and our marketing. You confirm the content is your own, accurate to the best of your knowledge, and does not infringe the rights of any third party.
14. Disclaimers
The Site and the products are provided on an “as is” and “as available” basis, except for warranties that cannot be excluded under applicable Canadian consumer-protection law. We do not guarantee that use of any product will produce specific cosmetic results, and individual hair conditions and stylist technique can affect outcomes. Always perform a strand test, follow manufacturer instructions, and discontinue use if irritation occurs.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
15. Limitation of Liability
To the fullest extent permitted by applicable law, [Legal Entity Name], its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or the products, including lost profits, lost data, or business interruption. Our total aggregate liability for any claim arising out of or relating to the Site or a product purchased from us will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including your rights under provincial consumer-protection legislation.
16. Indemnification
You agree to indemnify and hold harmless [Legal Entity Name] and its affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, your misuse of any product, or your violation of any law or third-party right.
17. Privacy
Your use of the Site is also governed by our Privacy Policy at https://hairtreatments.ca/privacy-policy/, which forms part of these Terms.
18. Third-Party Links
The Site may contain links to third-party websites or services. We do not control and are not responsible for the content, policies, or practices of any third-party site. Visiting third-party sites is at your own risk.
19. Changes to These Terms
We may update these Terms at any time by posting a revised version on the Site with an updated Effective Date. Material changes will be communicated via the Site or by email where appropriate. Your continued use of the Site after the changes take effect constitutes acceptance of the revised Terms.
20. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of [Province] and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts located in [City, Province] will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site, except where applicable consumer-protection law provides otherwise.
21. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Shipping Policy, Refund and Returns Policy, and Privacy Policy, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements.
